These terms of sale are concluded on the one hand by the company A3P2M with a share capital of €58,000, whose registered office is located at 21 Avenue des Templiers – 59840 Lompret, France registered with the Registry of Commerce and Companies of the Lille Court under number 908 573 041, hereinafter referred to as “A3P2M” and managing the site TABLE & NATURE, and on the other hand by any physical or legal person wishing to make a purchase via the website www.tableetnature.fr, hereinafter referred to as “the buyer”.

ARTICLE 1. PURPOSE

These terms of sale are intended to define the contractual relationship between A3P2M and the buyer and the conditions applicable to any purchase made through the website www.tableetnature.fr. The purchase of a product through this site implies the buyer’s unconditional acceptance of these terms of sale, which the buyer acknowledges having read prior to placing an order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the website www.tableetnature.fr is not directly related to their professional activity and is limited to strictly personal use, and on the other hand, that they have full legal capacity, allowing them to commit under these general terms of sale.

A3P2M reserves the right to modify these terms of sale at any time, in order to comply with any new regulations or to improve the use of its website. Therefore, the terms applicable will be those in effect on the date of the buyer’s order.

ARTICLE 2. PRODUCTS

The products offered are those listed on the website www.tableetnature.fr of the company A3P2M, subject to availability. The company A3P2M reserves the right to modify the product range at any time. Each product is presented on the website with a description outlining its main technical characteristics (capacity, usage, composition, etc.). The photographs are as accurate as possible but do not legally bind the Seller. The sale of products presented on the website www.tableetnature.fr is intended for all buyers residing in countries that fully allow the entry of these products into their territory.

ARTICLE 3. TARIFFS

The prices listed on the product sheets of the online catalogue are in Euros (€), all taxes included (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the product price. The company A3P2M reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the purchased products according to the total order amount. In metropolitan France, for any order equal to or over 50 euros TTC, shipping costs will be free only for delivery to a Pickup Point, while for home delivery via Colissimo, the applicable rates will be applied. For any order under 50 euros TTC, shipping costs will be charged to the buyer depending on the chosen delivery method, either Pickup Point or home.

ARTICLE 4. ORDER AND PAYMENT TERMS

Before placing any order, the buyer must create an account on the website www.tableetnature.fr. The account creation section is directly accessible from the side menu bar. On each visit, if the buyer wishes to place an order or check their account (order status, profile, etc.), they must log in using this information. The company A3P2M offers the buyer three payment options to order and pay for their products:

– Payment by cheque: the buyer selects the products they wish to order in the “cart”, modifies if necessary (quantities, references…), checks the delivery address or provides a new one. Then, shipping costs are calculated and presented to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: “Payment by cheque.” Finally, the last step allows them to review all information, read and accept the present general terms and conditions of sale by checking the corresponding box, and then invites them to confirm their order by clicking the “Confirm my order” button. This final click completes the definitive conclusion of the contract. Once confirmed, the buyer receives an order confirmation confirming the registration of their order. In order to complete their payment and trigger the processing of their order, the buyer must print this order form, accompanied by their cheque made payable to “SAS A3P2M” and send it to the following address: 21 av des Templiers 59840 LOMPRET. No cash payments should be sent. Only cheques issued by a French bank will be accepted. Upon receipt of the cheque, the order will be processed and the buyer will be notified by email. The company A3P2M will ship the products no earlier than 2 business days after the corresponding cheque has been cleared, subject to availability of funds.

– Payment by bank transfer: the buyer selects the products they wish to order in the “cart,” modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Next, the shipping costs are calculated and presented to the buyer, along with the carrier’s name. Then, the buyer chooses the desired payment method: “Payment by bank transfer.” Finally, the last step allows them to verify all the information, take note of and accept these general terms and conditions of sale by checking the corresponding box, and then prompts them to confirm their order by clicking the “Confirm my order” button. This final click signifies the definitive conclusion of the contract. Once confirmed, the buyer receives an order confirmation confirming the registration of their order. In order to complete their payment and initiate the processing of their order, the buyer must contact their bank to make the transfer corresponding to the amount of their order to A3P2M’s bank account, the details of which are provided to the buyer. Once the transfer is received, the order will be processed and the buyer will be informed by email. A3P2M will ship the products no earlier than 2 business days after receiving the transfer for the order, subject to availability.

– Secure payment by PayPal or credit card (via the PayPal system): the buyer selects the products they wish to order in the “cart,” modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and presented to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: “Pay with PayPal.” The following step allows them to review all the information, read and accept these general terms and conditions of sale by checking the corresponding box, and then prompts them to confirm their order by clicking the “Confirm my order” button. Finally, the buyer is redirected to the secure PayPal interface to safely enter their PayPal account or personal credit card details. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment via Paypal account or by bank card is irreversible. In case of fraudulent use of the card, the buyer may request the cancellation of the card payment, and the amounts paid will then be credited back or refunded. The cardholder is not liable if the disputed payment has been proven to have been made fraudulently, remotely, without the physical use of their card. To obtain reimbursement of the fraudulent debit and any bank fees that the transaction may have incurred, the cardholder must contest the charge in writing with their bank within 70 days of the transaction, or up to 120 days if the contract with the bank provides for it. The amounts debited are reimbursed by the bank within a maximum of one month after receipt of the written dispute submitted by the cardholder. No reimbursement fees may be charged to the cardholder.

Order confirmation constitutes acceptance of these terms and conditions of sale, acknowledgment of having full knowledge of them, and waiver of reliance on the buyer’s own purchasing terms. All data provided and the recorded confirmation will serve as proof of the transaction. If the buyer has an email address and has provided it on their order form, A3P2M will send confirmation of the order registration by email.

ARTICLE 5. RETENTION OF TITLE

A3P2M retains full ownership of the products sold until the full payment of the price, including principal, fees, and taxes.

ARTICLE 6. WITHDRAWAL

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty, except for return shipping costs.

ARTICLE 7. DELIVERY

Deliveries are made to the nearest collection point for orders over €50 or to the address indicated on the order form (which can only be within the agreed geographical area) for customers who have paid the additional fee for this service. Deliveries will be carried out by the provider selected by A3P2M for Point Relais deliveries and via La Poste and its COLISSIMO service for home deliveries with tracking, but no delivery requiring a signature will be accepted. Delivery times are provided for informational purposes only; if they exceed thirty days from the date of order, the sales contract may be terminated and the buyer refunded. A3P2M will then provide the buyer with the tracking number of their package by email. In the case of home delivery by its postal carrier, if the buyer is absent, they will receive a delivery notice from the carrier, allowing them to pick up the ordered products at the nearest post office within a period specified by the postal services. The risks associated with transportation remain the responsibility of the buyer from the moment the items leave the premises of A3P2M. The buyer is required to check the condition of the packaging and the contents of the goods in the presence of the postal clerk or the delivery person upon delivery. In the event of damage during transport, any complaint must be made to the carrier within three days of delivery.

ARTICLE 8. WARRANTY

All products provided by the company A3P2M are covered by the legal warranty provided for in Articles 1641 and following of the Civil Code. In the event of non-conformity of a sold product, it may be returned to A3P2M, which will take it back, exchange it, or refund it. All claims, exchange requests, or refund requests must be made by email, telephone, or postal mail to the following address: A3P2M – 21 av des Templiers 59840 LOMPRET, France, within thirty days of delivery.

ARTICLE 9. LIABILITY

The company A3P2M, in the process of remote sales, is only bound by an obligation of means. Its liability cannot be held for any damage resulting from the use of the Internet network, such as data loss, intrusion, viruses, service interruption, or other unintended issues.

ARTICLE 10. INTELLECTUAL PROPERTY

All elements of the website www.tableetnature.fr are and remain the intellectual property and exclusive property of the company A3P2M. No one is authorized to reproduce, exploit, or use in any way, even partially, any elements of the site, whether in the form of photos, logos, visuals, or text.

ARTICLE 11. PERSONAL DATA

The company A3P2M is committed to preserving the confidentiality of information provided by the buyer, which may be transmitted for the use of certain services. Any information concerning them is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the internet user has the right to access, modify, and delete information concerning them. ARTICLE 12. DISPUTE RESOLUTION

These distance selling terms and conditions are subject to French law. For any disputes or litigation, the competent court will be that of Lille.
